1. Introduction and Acceptance
These Terms and Conditions are intended to govern access to and use of the Mi Feria website and mobile application (hereinafter collectively referred to as "the Platform"), owned and operated by the Limited Liability Company (LLC), legal entity ID No. 3-102-954834. By accessing and using the Platform, you (hereinafter, "the User") freely and informedly agree to comply with these Terms and Conditions, which constitute a legally binding agreement between the User and the LLC. If you disagree with any of these terms, we ask that you do not use our services.
2. Service Description
Mi Feria is a digital platform that operates under two clearly differentiated modules:
- (a) LOCAL MARKET: An exclusively informational and geolocation module that allows Users to consult the location, products and vendors present at the Costa Rica Farmers' Market grounds. This module does not constitute an e-commerce platform and does not intermediate in commercial transactions of any nature.
- (b) ONLINE MARKET: A transactional e-commerce module that allows Users to place orders for market products. Purchases made through this module are subject to the specific conditions established in these Terms.
Mi Feria is a technological tool that adds value to farmers markets by providing product picking, packing, and delivery services when requested by the User. The LLC does not at any time acquire ownership of the products sold, nor does it act as legal representative of the participating farmers or vendors.
3. Registration and User Accounts
Access to Mi Feria's public website does not require registration. An account is required only to use the mobile application. By registering, you agree to:
- Provide truthful, accurate, and up-to-date information.
- Maintain the confidentiality of your access credentials.
- Immediately report any unauthorized use of your account.
- Be responsible for all activities carried out under your account.
We reserve the right to suspend or terminate accounts for violations of the law, these Terms, or activities that compromise the security or operation of the platform.
4. Acceptable Use
By using Mi Feria, you agree not to:
- Use the Platform for illegal or unauthorized purposes.
- Interfere with the normal operation of the Platform.
- Post false, misleading, offensive, or defamatory content.
- Attempt to access other users' accounts, systems, or data.
- Reproduce, duplicate, or resell any part of the service, including editorial content, data of the Platform, design, code, or vendor and product information, without prior written authorization from Mi Feria.
By using the Platform, the User declares that they have full legal capacity to act in their own name. If placing orders on behalf of a legal entity for electronic invoicing purposes, the User warrants that they hold the necessary authority to represent it in such act.
5. Orders, Transactions, and Exclusive Purchase Channel
When placing an order through Mi Feria, the User expressly agrees to the following conditions:
- EXCLUSIVE PURCHASE CHANNEL: The official Mi Feria mobile application is the only valid channel for placing orders. Orders generated through the application are recorded in the system and constitute the only evidence recognized by Mi Feria. No order placed through any other channel will be valid, except in the event of a duly confirmed technical failure in the mobile application, in which case Mi Feria may exceptionally enable WhatsApp as an alternative channel to process orders, subject to obtaining the customer's express consent to the use of their personal data for that specific purpose.
- ORDER SPECIFICATIONS: Any special instructions, product preferences (ripeness, size, cut, packaging, or other characteristics), or delivery details must be provided by the User within the application at the time of processing the order. Once the order is confirmed, no modifications to the specifications will be accepted. Mi Feria and vendors will not assume any responsibility for instructions communicated through external channels, except in the exceptional cases established in the preceding point.
- INTERNAL REPORTING PERIOD: To ensure timely assistance from Mi Feria, the User should report any dissatisfaction, damaged product, missing item, or order error within twenty-four (24) calendar hours following the delivery confirmed by the system, via WhatsApp or to contacto@miferiacr.com, attaching photographic or documentary evidence of the issue. This period corresponds to Mi Feria's internal incident handling procedure and does not constitute a waiver of or limitation on the rights granted to the consumer by Law No. 7472, the Law on Promotion of Competition and Effective Consumer Protection, and other applicable legislation.
- PRODUCT RESPONSIBILITY: The quality, freshness, safety, and condition of the products is the exclusive responsibility of the corresponding vendor or farmer. Each farmer or vendor is solely responsible for compliance with applicable health, food safety, quality, weight, pricing, and labeling regulations for the products they sell, in accordance with the laws in force in the Republic of Costa Rica. Mi Feria, as a technological platform supporting farmers markets, is not a producer, distributor, or direct seller of the offered products, and assumes no liability for any failure by vendors, farmers, or the farmers market administration to comply with such regulations.
- DELIVERY TIMES: Deliveries are made on the same days the farmers markets take place, as products are sourced directly from them. In exceptional cases, due to causes beyond Mi Feria's control, delivery may take place the day after the corresponding market. Mi Feria does not guarantee exact delivery times and any estimates communicated via WhatsApp may vary based on operating conditions.
- BINDING PRICE: The applicable price for each order is the one in effect at the time the User confirms and processes the order within the application. Said price is fixed for that specific order once confirmation is generated. Price changes will not affect already confirmed orders.
- CANCELLATIONS: The User may request order cancellation directly from the mobile application, within thirty (30) minutes following confirmation, provided the order has not begun preparation or dispatch. Once preparation has started, cancellation will not proceed.
- ELECTRONIC INVOICE: The User may request the issuance of an electronic invoice through Costa Rica's Ministry of Finance (Hacienda) by indicating so at the time of placing the order from the mobile application, via WhatsApp or at contacto@miferiacr.com, providing the corresponding tax information.
5B. Disclaimer of Liability — Local Market Module
The Local Market module is exclusively informational in nature. Information published about products, prices, availability, stall locations, and vendor schedules at the market grounds is provided by the vendors and farmers themselves, or provided by the market administration, and may not reflect real-time conditions at the market. Mi Feria assumes no responsibility for: (i) the accuracy or currency of information published in the Local Market module; (ii) the quality, price, stock, or condition of products offered directly and in person by vendors at the market; (iii) deals, agreements, transactions, or conflicts arising directly between the User and vendors or farmers at the physical market space; or (iv) the results of physical interactions that the User undertakes based on information consulted in the Local Market module. Any purchase, payment, or exchange of products conducted in person between the User and vendors or farmers at the market grounds is the exclusive responsibility of the parties involved, with Mi Feria having no participation, liability, or backing over such operations.
6. Intellectual Property
All content on the Platform, including but not limited to texts, graphics, logos, images, software, and design, is the property of Mi Feria or their respective authors and license providers (including open source libraries, icons, typefaces, and third-party images used) and is protected by Costa Rica's intellectual property laws and applicable international treaties. Reproduction, distribution, or modification without prior written authorization is prohibited.
7. Limitation of Liability
Without prejudice to the provisions of Costa Rica's Law No. 7472 on Promotion of Competition and Effective Consumer Protection, Mi Feria shall not be liable for:
- Temporary service interruptions due to maintenance or force majeure.
- Indirect, incidental, or consequential damages arising from use of the Platform.
- Actions, omissions, or products of third parties, including vendors and farmers.
- Loss or corruption of data caused by third-party infrastructure failures, cyberattacks, natural disasters, or other circumstances beyond Mi Feria's reasonable control.
In no event shall Mi Feria's total cumulative liability to the User for any claim arising from use of the Platform exceed the amount actually paid by the User in the specific transaction giving rise to the claim. The service is provided "as is" and "as available", without additional warranties of any kind, express or implied, to the maximum extent permitted by applicable law. Nothing in this section limits or excludes LLC's liability in cases where Costa Rican law does not permit such limitation or exclusion, including the non-waivable rights recognized to consumers under Law No. 7472 and other applicable regulations.
8. Modifications
We reserve the right to modify these terms and conditions at any time. Modifications will take effect upon being updated on this web page. Continued use of the service after such modifications constitutes your acceptance of the updated terms. Modifications will not affect orders already confirmed or legal situations consolidated prior to their entry into force.
9. Applicable Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Costa Rica, including, among others, Law No. 7472, Law on Promotion of Competition and Effective Consumer Protection; Law No. 8454, Law on Certificates, Digital Signatures, and Electronic Documents; and any other applicable regulations. The parties shall endeavor to resolve in good faith any dispute arising from the interpretation, performance, or application of these Terms and Conditions through direct communication. If no resolution is reached, the dispute may be submitted to the competent administrative authorities or courts of the Republic of Costa Rica, as appropriate under applicable law. Nothing contained in these Terms and Conditions shall be interpreted as limiting, restricting, or waiving the rights that Costa Rican law recognizes for consumers or users.
10. Force Majeure
Mi Feria shall not be liable for partial or total non-compliance with its obligations when such non-compliance is caused by force majeure or fortuitous events beyond the Platform's reasonable control, including but not limited to: natural disasters, pandemics, governmental authority acts, telecommunications infrastructure failures, cyberattacks, suspension of external provider services, or any other unforeseeable and irresistible event. In such events, Mi Feria will notify affected users to the extent possible and will adopt reasonable measures to minimize the impact.
